Yes, Amazon must play by the same rules. Our friend Azure is at it again. What is it exactly? Because they purchased the server with Software Assurance, Microsoft will allow them to run a separate instance in Azure and only pay the Linux VM rate.
This same customer can now deploy an image in Azure, pay a non Windows rate in Azure , and still run an on premise server in their own datacenter to make a true hybrid scenario.
They can do this with Datacenter edition only, since Datacenter allows unlimited virtual instances. They cannot run a true hybrid with Standard. They must either run on premise or in Azure with Standard edition. If you are on the fence about which version to purchase, Datacenter might just win out. A couple of things to consider. If you purchased Datacenter that has two processor licenses, this will all you to run two instances up to 8 cores or 1 instance up to 16 cores in Azure.
In other words, you cannot exceed the number of licenses you purchased. With perpetual licensing, you have a reduced workforce, you still have to pay for the seasonal employee licenses even when they are not being utilized. Please keep in mind that I have dealt with Microsoft licensing for over 20 years, but I am no licensing expert. My thoughts below are based on my understanding of Microsoft licensing as it applies to the MyCloudIT business model.
The CAL is a perpetual license that must be acquired in advance. This means that those CALs will also require yearly or every few year payments to stay current. Most customers that leverage public clouds have moved their licensing needs to the consumption-based model that SPLA provides.

In all cases, under a CAL Suite, your use rights with respect to a particular product or online service are the same as if that component were licensed separately. The only exception is that both per-user and per-device options are available in CAL Suites, even when both options are not available outside the suite.
CAL Suites are offered only with Software Assurance coverage, and they therefore provide you with the right to use the most recent version of every product in the suite. If Software Assurance coverage lapses and you are vested with perpetual rights, use rights are determined by the latest version of the products that were in effect prior to the lapse in coverage.
